My name is Ken Dunbar; I am an internet radio talk host, who has interviewed other State Representatives and Senators on various topics.

I received an email today, that you have contacted your State's Secretary of State , on the issue of Mr. Obama’s citizenship.

Please know that I have researched the Constitution issue since mid-November 2008, and I invite you to share this information.

While the birth certificate is an important topic, in that Obama’s campaign produced a 2007 computer image of a short form, and that it had no State Seal on it, and that it does not have the name of the hospital, attending physician on it… the Constitution does not require that candidates or the President –elect or the President produce his original long form birth certificate. Such a document would prove ONE thing only: where he was born.

The Constitution does require that he be a “natural born citizen”, and this is the real issue. What is the definition of that specific three-word term? Not what *I* say it means, nor what anyone *thinks* it means, but what is its historical meaning.

I shall be brief here.

In December 1775, Benjamin Franklin wrote a letter to his nfriend Mr Dumas of the Seven United Provinces of the Netherlands, thanking him for three copies of Emer Vattel’s book “Law of Nations”, that one copy was in the hands of the Continental Congress.

That book gave the definition of such terms as “state”, “republic”, “constitution”, and “natural born citizen”. While Vattel did not create these terms and their definitions, these were the known definitions to Western Civilization. http://www.constitution.org/vattel/vattel.htm

“The natives, or natural-born citizens, are those born in the country, of parents who are citizens. As the society cannot exist and perpetuate itself otherwise than by the children of the citizens, those children naturally follow the condition of their fathers, and succeed to all their rights.” “Law of Nations”, Book I, Chapter 19, § 212

Further, Attorney George Collins, writing in “The American Law Review” magazine of Sept/Oct 1884 explained that “persons born within the United States are not ipso facto citizens thereof.” Being born on the soil was not enough to be a citizen at birth.

And, in 1885, US Secretary of State Thomas Baynard verfied the same stance which was recorded in the August 23, 1894 edition of “The Nation” magazine”, which states in part, “In 1885, Secretary Bayard decided that ‘the son of a German subject, born in Ohio, was not a citizen under the statute or the Constitution, because “he was on his birth ‘subject to a foreign power,’ and ‘not subject to the jurisdiction of the United States’.”

In 2008, Mr. Obama’s campaign website (still available online) shared that,
“When Barack Obama Jr. was born on Aug. 4,1961, in Honolulu, Kenya was a British colony, still part of the United Kingdom’s dwindling empire. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.‘s children.”

The legal and Constitutional question before us is clear: “How can British law ‘govern the birth status’ of an American ‘natural born citizen’?”

Obama may prove to be an American citizen, through US legislative law, as any person born on the soil is now granted citizenship. But, he can never be an American “natural born citizen”, having been born British through British law.

I think that there is still a very big legal question as to whether or not a child of parents, neither of whom are US citizens, and one or both of whom are not permanently domiciled in the USA, can automatically claim US citizenship, merely by the circumstance of being born on US soil. Some US immigration and naturalization officials may have been granting, ERRONEOUSLY, US citizen status to so called 'anchor babies'.
